The southern border and Title 42

 

Title 42 is a Trump era action started by the Trump Administration, and continued  by the Biden Administration.  However, President Biden and his administration have stated they will end Title 42 expulsions in late May.   Title 42 is the use of a 1944 public health law giving the U.S. authority to immediately return immigrants to the country of origin over public health concerns, namely COVID.

Critics of President Joe Biden point to a presidential debate during which Biden stated he hopes immigrants “surge” the border.  That is exactly what has happened.  

We will includes links to different sides of this story.    The Union representing Border Patrol agents are critical for the so called “open border” policy of Joe Biden.  Those on the left say America needs meaningful immigration reform and we should allow people begging for a better way of life a means to enter the U.S.   

Opponents warn this will put an increasing strain on law enforcement and the American taxpayer if American’s have to continue to pay for health insurance, housing, schooling and other services for immigrants.  They warn American’s can’t afford the increased cost.

The southern border is a complicated issue and we need to closely examine all sides.  Editorially, we believe Title 42 should stay in effect.  America needs to look at ways to provide a meaningful, lawful way to enter this country without simply throwing the gates open and allowing every  into America.  This continued practice will put all American communities at risk because some  people immigrating do not have positive reasons to coming into this country.  They come to commit crimes.  Not all are criminals, but we have to be able to control the flow of immigration into the United States. 

Title 42 US. code

Title 42 of the United States Code, Chapter 6A, Subchapter II, Part G, Section 265 states:[5]

§265. Suspension of entries and imports from designated places to prevent spread of communicable diseases

Whenever the Surgeon General determines that by reason of the existence of any communicable disease in a foreign country there is serious danger of the introduction of such disease into the United States, and that this danger is so increased by the introduction of persons or property from such country that a suspension of the right to introduce such persons and property is required in the interest of the public health, the Surgeon General, in accordance with regulations approved by the President, shall have the power to prohibit, in whole or in part, the introduction of persons and property from such countries or places as he shall designate in order to avert such danger, and for such period of time as he may deem necessary for such purpose. (July 1, 1944, ch. 373, title III, §362, 58 Stat. 704.)
